Kochi: The Supreme Court has allowed the Delhi Development Authority to demolish a Shiva Temple located on the Yamuna floodplains, media reports said.
Upholding a verdict of Delhi High Court of May 29, the Apex Court held that there was no infirmity in the High Court order, the reports said.The Supreme Court asked Pracheen Shiv Mandir Avam Akhada Samiti as to “How can you have an akhada in floodplains? “
The High Court had allowed demolition of the Pracheen Shiva Mandir located near Taj Enclave at Geeta Colony.The Delhi High Court had further observed that the mere fact that prayers are offered at the temple every day and holding of special events on certain festive occasions would not make the temple in question to a place of public significance.
The High Court had stated there was no document to show that the temple was dedicated to the public and not a private temple managed by the petitioner society.The High Court observed that the Delhi Development Authority shall be at liberty to demolish the unauthorised construction, and the petitioner society and its members shall not cause any impediment or obstacles in the demolition process.
The Akhada Samiti had moved the Supreme Court against the High Court order which was upheld by the Apex Court, the reports said.
