Kochi: The Supreme Court today held that a Muslim woman can seek maintenance from her Ex husband under Section 125 of the Code of Criminal Procedure, media reports said.
A division bench of the Apex Court made the observation while hearing a petition of one Abdul Samad challenging a Telangana High Court’s direction to pay ₹10,000 interim maintenance to his ex-wife.
Earlier, a family court had directed Samad to pay a monthly interim maintenance of ₹20,000 to his ex-wife.
Samad challenged the Family Court verdict before the Telangana High Court arguing that the divorce was executed under the Muslim personal law.
He argued that a divorced Muslim woman is not entitled to claim alimony under Section 125 CrPC of the Muslim Women (Protection of Rights on Divorce) Act, 1986, reported Bar and Bench. The High Court reduced the maintenance to ₹10,000 per month.
