Kochi: The High Court of Kerala on Monday stayed the FIR registered against former Chief Minister Pinarayi Vijayan, daughter Veena and her husband Muhammed Riyas, MLA, in cases including CMRL-Exalogic pay off.
The Division Bench stayed the further investigation in the case as well as the judgment of the Single Bench which ordered to register the FIR against them
The Court admitted the appeals and posted them after 3 weeks for final hearing, media reports said.
The state said that it had formed an SIT to conduct a preliminary inquiry based on the findings of the Directorate of Enforcement accusing Pinarayi and family members of allegedly indulging in financial frauds.
The Enforcement Directorate argued that an FIR was mandatory when information disclosed a cognisable offence.
It contended that the Companies Act provision granting the Serious Fraud Investigation Office jurisdiction did not bar proceedings under the Prevention of Money Laundering Act (PMLA).
