HC adjourns Mohan Lal’s Case

Kochi: Adjourning actor Mohanlal’s Ivory possession case post vacation, the Kerala High Court observed that the actor cannot challenge the case pending against him in a lower court in Perumbavoor.

The High Court said that Mohan Lal had no locus standi to seek withdrawal of the case and it was the government which could have move the application.

The court observed that under the Criminal Procedure Code, the accused had no power to seek withdrawal of proceedings against him.

The actor had challenged the Judicial First Class Magistrate’s Court order passed by JFCM dismissing the State Government’s plea to withdraw prosecution proceedings against him in the ivory case against him.

Claiming that he was in possession of the ownership certificate of the ivory, Mohan Lal
challenged the recent order of the Perumbavoor court which had dismissed the prosecution’s demand to withdraw proceedings against Lal initiated on the basis of a case registered by the Forest Department under the Wild Life (Protection) Act, 1972 about a decade back.

The Forest Department had accused him of illegally possessing the ivory which was
unearthed by the Income Tax department from his house in Thevara during a raid conducted in his house in 2011.
