Kochi: The Supreme Court today rejected a plea seeking approval of same-sex marriages in the country, media reports said.Delivering the verdict by a five-judge bench, the court said that the matter was out of its domain and parliament should make laws in this regard, the reports said.
However, the court said the state should provide some legal protections to same-sex couples on the basis of their fundamental rights, the reports said.The Union government opposed the petition and prayed that the matter be handled by parliament.
Two same sex couples moved the apex court on November 25th, 2022, seeking legal recognition of same-sex marriages in the country.The petitioners argued that Section 4(c) of the Special Marriage Act, 1954, was unconstitutional and discriminatory as they recognised marriage only between a ‘male’ and a ‘female’ and not the same-sex couples.
The petitioners argued that non-recognition of same-sex marriage violated the rights to equality, freedom of expression and dignity.
